Federal Laws

  • Campus Sexual Violence Elimination Act (Campus SaVE Act)

    The Campus SaVE Act, enacted in March 2013, amended the Clery Act to require that incidents of dating violence, domestic violence, sexual assault, and stalking be disclosed in annual campus crime statistics reports. The Campus SaVE Act also created additional protections for victims and enacted more prescriptive requirements for prevention and awareness programs related to these offenses.

  • Jeanne Clery Campus Safety Act (Clery Act)

    Requires colleges and universities that participate in federal financial aid programs to report annual statistics on crime on or near their campuses, including sexual assault and rape, and to develop prevention policies in an Annual Security Report (ASR).

  • Title IV of the Civil Rights Act of 1964 (Title IV)

    Prohibits discrimination on the basis of race, color, national origin, sex, and religion in programs and activities receiving federal funding.

  • Title VII of the Civil Rights Act of 1964 (Title VII)

    Prohibits discrimination by employers on the basis of race, color, religion, sex, or national origin, including discrimination by association.

  • Title IX of the Education Amendments of 1972 (Title IX)

    Prohibits sex discrimination in educational programs receiving federal funding, covering students and employees, including sexual harassment and assault. Requires schools to prevent and respond to violations and was amended in 2020 to include dating violence, domestic violence, and stalking in its definition of sexual harassment.

  • Violence Against Women Act (VAWA)

    Established federal legal definitions of dating violence, domestic violence, sexual assault, and stalking, and amended the Clery Act to include requirements for reporting and responding to such incidents.

Texas State Laws

The State of Texas has enacted several laws regarding policies for reporting and investigating incidents of dating violence, sexual assault, sexual harassment, and stalking. There are also laws regarding pregnant and parenting students' rights.

  • Texas House Bill 1735 86(R)

    Relates to sexual harassment, sexual assault, dating violence, and stalking at postsecondary educational institutions and provides administrative penalties.

  • Texas House Bill 1361 88(R)

    Relates to the designation of liaison officers to assist parenting students at public institutions of higher education.

  • Texas Senate Bill 968 85(R)

    Relates to sexual assault policies at institutions of higher education and electronic reporting options for offenses.

    Relates to reporting requirements for incidents of sexual harassment, sexual assault, dating violence, or stalking, creating criminal offenses and administrative penalties.
